Plausible deniability all the way down. The warnings were issued, but somehow no one knew anything and no one is guilty of anything.
The State Department technician who set up Hillary Clinton’s private server told FBI officials that he conveyed internal concerns that the setup violated federal record-keeping rules to Clinton’s “inner circle,” according to investigation notes released Friday afternoon.
Bryan Pagliano told investigators that in 2009, two State IT specialists asked him whether he was aware of the clintonemail.com domain, then asked him to relay to Clinton’s team that the server could be a federal records retention issue.
Pagliano conveyed the message to Cheryl Mills, Clinton’s chief of staff during her tenure as secretary of State.
So there was in fact awareness within State that Hillary's email setup was illegal. Nothing was done about it beyond passing meaningless messages. Everyone successfully covered themselves while the violations continued. Hillary claims she had no idea that what she was doing was illegal. Messages were passed along that it was illegal, but they supposedly never reached her.
Mills received immunity and wasn't charged with anything. No doubt she filed a piece of paperwork expressing her concerns somewhere too. This is how lawyers break the law.
